RE: Thailand’s Human Rights Abuse by the Military Junta
Dear Secretary Kerry,
I am writing to inform you that in the wake of the coup that overthrew the democratically elected government of PM Yingluck Shinawatra in May 22, 2014, at least 6 activists say that they were tortured while in custody, some 70 civilians face trials in military courts, and dissent and freedom of expression have been sharply restricted.
The right to a fair trial is currently in jeopardy. In some cases, there is absolutely no justification for an arrest whatsoever. One mother was arrested for merely uttering a word “yeah” in a haphazard manner concurring to a simple statement which was allegedly deemed a violation of “lese majeste” law by the Thai authorities.
All versions of the Thai consitution since 1932 contain the clause, “The king shall be enthroned in a position of revered worship and shall not be violated. No person shall expose the king to any sort of accusation or action." The Thai Criminal Code elaborates in Section 112, also known as “lese majeste law”: "Whoever defames, insults or threatens the king, queen, heir-apparent, or regent shall be punished with imprisonment of three to fifteen years. Missing from the code, however, is a definition of what actions constitute "defamation" or "insult".
The people facing military trials, which offer no appeal, are charged with taking part in political gatherings, protesting against the military takeover of the country or insulting the monarchy.
Because of the gross violation of human rights in Thailand, I have exercised my rights of free speech under the First Amendment of the Constitution of the United States in the U.S. soil. I have been critical of the military junta headed by Gen. Prayuth Chan Ocha in my Facebook under my real name, “Narisara Viwatchara” during the past two years. Due to my action, I have been subject to intimidation by Thai royalists and military thugs in social media and phone calls.
I plan on making a trip to Thailand this summer during the month of July and August 2016 for holidays and a research project.
As a U.S. citizen of Thai descent, I hereby request that the U.S. Embassy in Bangkok be made aware of my presence and that I will be protected, in case the military junta compels me to report to them for the so-called “attitude adjustment.”
I will, of course, promptly register my name and provide my contact information to the U.S. Embassy staff upon my arrival in Bangkok.

ในยามนี้บ้านเราก็เหมือนบ้านป่าเมืองเถื่อน การกระทำต่อผู้เห็นต่างโดยมิได้คำนึงถึงหลักของข้อกฏหมายทั่วไปและยิ่งไม่ต้องพูดถึงหลักสิทธิมนุษยชนที่พึงต้องยึดถือ ที่แล้วมาเห็นได้อย่างชัดเจนว่ามีการจับกุมผู้เห็นต่างก่อนที่จะมีการแจ้งข้อกล่าวหาอยู่หลายคดี จึงมิควรประมาทในเรื่องเช่นนี้จะเป็นการดี และขอต้อนรับการกลับสู่บ้านเกิดเมืองนอนด้วยความยินดีครับ
