จดหมาย ‘เร็ดยูเอสเอ’ เขียนถึงเอกอัคราชทูต กลิน ที เดวี่ส์ “รายงานบุคคลที่ละเมิดสิทธิมนุษยชน ชื่อ เสรี วงษ์มณฑา”

อย่างนี้ต้องว่า เสรีเจอคู่ฟัด หรือใช้ภาษาฝรั่งยูเอสก็ “Seri got his match.”

เมื่อ Kim Lee (Prachuab Charoensuk) เขียนจดหมายถึงเอกอัคราชทูต กลิน ที เดวี่ส์ ในนาม ‘เร็ดยูเอสเอ’

“รายงานบุคคลที่ละเมิดสิทธิมนุษยชน ชื่อ เสรี วงษ์มณฑา”

อันเนื่องมาแต่การเขียนเฟชบุ๊คของ เสรี วงษ์มณฑา ผู้สนับสนุนการชุมนุมขับไล่รัฐบาลยิ่งลักษณ์ ชินวัตร ระดับแกนนำอันแข็งขันในการ ‘เป่านกหวีด ปิดกรุงเทพฯ’ อ้างว่าอายุมากแล้วจะไปใช้ชีวิตบั้นปลายขายก๋วยเตี๋ยวที่อเมริกา

เสรียังเขียนคุยด้วยว่ามีบ้านสามหลังที่ชิคาโกยังตกลงใจไม่ถูกว่าจะอยู่หลังไหนดี สองหลังแรกนั้นหลังหนึ่งช่วยหลานผ่อนส่งมาระยะหนึ่ง อีกหลังออกเงินวางมัดจำ ‘down payment’ ให้หลานส่งต่อ หลังที่สามซื้อเองส่งเอง คิดว่าอาจจะเลือกที่นี่

จดหมายเร็ดยูเอสเออ้างอิงกฎหมายฉบับหนึ่งซึ่งประธานาธิบดีโอบาม่าของสหรัฐลงนามประกาศใช้เมื่อวันที่ ๔ สิงหาคม ๒๕๕๔ อันมีผลต่อการจะเดินทางเข้าสหรัฐของบุคคลจำนวนหนึ่ง อันเนื่องจากเนื้อหาของกฎหมายโดยสรุประบุว่า

“ไม่อนุญาตให้เดินทางเข้าประเทศทั้งในกรณีผู้อพยพและไม่ใช่ผู้อพยพ ต่อบุคคลต่างๆ ที่มีส่วนร่วมในการปฏิบัติขัดกับสิทธิมนุษยชนรุนแรง และละเมิดกฎหมายเกี่ยวกับสิทธิมนุษยชน กับการกระทำรุนแรงอื่นๆ”

จดหมายชี้ว่า เสรี วงษ์มณฑา ผู้เป็นนักกิจกรรมต่อต้านสิทธิมนุษยชน สนับสนุนการใช้กฎหมายหมิ่นพระบรมเดชานุภาพ ด้วยการเป็นโจทก์ฟ้องร้องนักต่อสู้เพื่อสิทธิมนุษยชนเพื่อแก้แค้น ที่ความคิดเห็นของพวกเขาขัดแย้งกับตน ในข้อหาอาญา ม.๑๑๒

(อันมีระวางโทษร้ายแรงให้จำคุกกระทงละ ๓-๑๕ ปีต่อข้อหาดูหมิ่นพระมหากษัตริย์ พระราชินี องค์รัชทายาท และผู้สำเร็จราชการแทนพระองค์ ซึ่งก่อให้เกิดการนำไปใช้ทำลายล้างต่อกันทางการเมือง)

“เสรี วงษ์มณฑา ยังเป็นนักกิจกรรมแก่นแข็งในกลุ่มแกนนำฝ่ายเสื้อเหลือง ซึ่งร่วมกระทำการนอกเหนือกฎหมายในการ ‘ปิดกรุงเทพฯ’ ตั้งแต่เดือนพฤศจิกายน ๒๕๕๖ ถึง ๒๒ พฤษภาคม ๒๕๕๗

มีการเข้ายึดสถานที่ราชการ ตัดขาดระบบสาธานูปโภคอาคารเหล่านั้น แล้วยังพยายามจะบุกเข้าไปในที่ทำการสถานทูตสหรัฐ และขับไล่เอกอัครราชทูตคริสตี้ เค็นนี่ ขณะนั้นของเรา (ชาวอเมริกัน) ให้ออกนอกประเทศ”

“พิจารณาจากพฤติกรรมขัดขวางกระบวนการสิทธิมนุษยชน และต่อต้านประชาธิปไตยในประเทศไทย (ของเสรี วงษ์มณฑา) ต่างๆ ข้างต้น เขาไม่ควรได้รับวีซ่าอนุญาตให้เดินทางเข้าประเทศสหรัฐ

ถ้าหากเขามีวีซ่าดังกล่าวอยู่แล้ว ก็ขอให้ระงับยับยั้งไปเสีย” จดหมายวิงวอนเรียกร้อง

Re: Reporting of a human rights violator: Seri Wongmonta
Dear Ambassador Davies:

On August 4, 2011, President Obama signed into law the following declaration which will have an impact on a number of people attempting to travel to the United States. The presidential proclamation could be summarized as the suspension of entry as immigrants and nonimmigrants of persons who participate in serious human rights and humanitarian law violations and other abuses.

As you know, Thailand's draconian lese majeste law (Article 112) is an extremely anti-human rights law. It prohibits people from speaking their mind and telling the truth regarding the king, queen, heir apparent and regents. It carries a very harsh punishment of 3-15 years in jail for each offense.
Unfortunately, some individuals abuse this law and file the complaint with the police causing great misery including mental anguish to the accused. This action is a blatant violation of human rights and humanitarian law violations.

I wish to report to you Seri Wongmonta, a vocal anti-human rights activist and an active supporter of lese majeste law. He was reported to have filed Article 112 with the police against human rights activists who oppose his views as a revenge.

Seri Wongmonta is also one of the hardcore yellow-shirt leaders, who illegally staged a demonstration with his hooligan mobs in shutting down Bangkok from November 2013 thru May 22, 2014. They occupied the government buildings, cutoff their utilities, attempted to enter the US Embassy and demanded that Kristy Kenny, our ambassador at the time leave Thailand. They had successfully overthrown an elected government by encouraging a coup d'é•tat. Under his lobbying efforts, several new draconian laws have been iฤmplemented and included in the current army’s draft constitution.

In view of the above, he should not be granted US visas due to his anti-human rights and anti-democracy movements in Thailand. If the visas had been inadvertently issued, please revoke them.

Presently, he is bragging with the Thai mass media that he is buying a property in Chicago and that he will likely enter the United States as a permanent resident or temporary tourist visa which he might have obtained earlier.
