คำพิพากษา
- เพิ่มโทษจำคุกนายเพ็ทอีก 18 เดือน จากคำพิพากษาศาลชั้นต้นศาลชั้นต้น 30 เดือน รวมเป็นจำคุก 48เดือน(4ปี)
- จำเลยต้องชดใช้ค่าสินไหมให้อั้ม เนโกะเพิ่มไปอีก1,000ยูโร จากคำพิพากษาศาลชั้นต้นเดิม
- ยึดมือถือไอโฟนของกลางทั้งหมด
- เมื่อครบกำหนดโทษ จะถูกเนรเทศและห้ามเข้าสาธารณรัฐฝรั่งเศสตลอดชีวิต (เพิ่มมาจากข้อเสนอของอัยการปารีส เพื่อคุ้มครองความปลอดภัยผู้ลี้ภัยการเมือง)

บ่ายวันนี้ ศาลอุทธรณ์ปารีส จะมีการพิพากษาคดีจ้างวานทำร้ายร่างกายผู้ลี้ภัย112ไทยในปารีส นายเพ็ท โดนาเท็ค เจ้าของสำนักดาบบูชิโด สัญชาติเช็ก จำเลยที่3ซึ่งเป็นผู้จ้างวานนักมวย2คนมาทำร้าย อั้ม เนโกะ ในคืนวันที่ 17 พ.ย. 2019 ซึ่งผมได้เข้าไปช่วยและบาดเจ็บไปด้วยนิดหน่อย
ศาลชั้นต้นได้พิพากษาจำเลยนักมวยชาวเช็ก 2 รายจำคุก 22 เดือน ปรับเกือบ 4,000 ยูโร และห้ามเข้าฝรั่งเศส 5 ปี และจำคุกจำเลยที่3ผู้จ้างวาน 30 เดือนและเนรเทศ 5 ปี
โดยจำเลยที่1และ2รับสารภาพว่านายเพ็ท จำเลยที่ 3ได้จ้างวานจัดหา และอัยการมีหลักฐานมือถือของทั้ง2และกล้องวงจรปิดการนัดพบกันก่อนก่อเหตุ
แต่นายเพ็ท จำเลยที่ 3 ไม่เคยมาร่วมพิจารณาคดีและฟังคำตัดสินตลอดกระบวนการ จึงถูกหมายจับInterpol Europe และถูกตำรวจยุโรปจับกุมตัวได้ที่อิตาลีขณะไปเที่ยวกับภรรยา เมื่อเดือนตุลาคม 2022
นายเพ็ทถูกฝากขังมาจนถึงปัจจุบันและได้ยื่นอุทธรณ์ต่อศาลอุทธรณ์ว่าตนไม่เกี่ยวข้องและขอสู้คดีให้ศาลทบทวนยุติการลงโทษทั้งหมด อัยการปารีสเสนอให้ศาลเพิ่มโทษเป็นจำคุก 5 ปี และห้ามเข้าฝรั่งเศสตลอดชีวิต เพราะผู้ถูกทำร้ายเป็นผู้ลี้ภัยการเมืองที่อยู่ในการรับประกันความคุ้มครองความปลอดภัยโดยรัฐบาลฝรั่งเศส

My thoughts on the Donatek verdict -
The first verdict had sentenced Daniel Vokal and Jakub Hosek to 26 months in jail for attacking two Thai refugees in the streets of Paris, and Petr Donatek in absentia to 30 months in jail for masterminding that attack.
It was a rather harsh sentence - certainly harsher than if the same injuries had resulted from a drunken brawl in a bar, for example. But then it was a premeditated assault, and the court probably took the context into account: a crime carried out by an international mafia, and evidently motivated by ideology against political refugees that France had chosen to protect.
There may also be the fact that Vokal and Hosek had been in pre-trial detention for about two years, so the court would rather retrospectively sentence them to time they had served anyway, than open the door to claims for compensation.
Petr Donatek had escaped France before the judgment, and the Czech republic had declined to deport him to France. But then he got arrested in Italy in 2022 on a European arrest warrant, and deported to France. He has been staying in the prison of Fresnes, which notoriously is one of the worst French prisons when it comes to dilapidation, lack of maintenance, and overcrowding.
He decided to appeal after he was arrested. The appeal court eventually sentenced him to 48 months in jail and a permanent ban on entering French territory: a much more severe sentence than the first one. This surprised everybody.
He had decided to deny any involvement despite ample evidence of the opposite, so it is possible that the appeal court felt like being taken for fools, and punished him for that.
It was a very misguided strategy on his part. It allowed him to brush off the question of who ordered the crime and paid for it, which would obviously have popped up. But then, the safest way to avoid answering this question would have been to accept the initial sentence and serve it.
Why didn't he choose to give his "client" away in hope for a reduced sentence? My guess is that he fears possible retaliation on his wife and children.
I hope the facts will come out someday, one way or another.
