ผมรู้สึกกังวลเป็นอย่างยิ่งต่อคำตัดสินของศาลจังหวัดเชียงใหม่ กรณีสั่งจำคุก 7 เดือน ผู้สื่อข่าวชาวเมียนมาร์ 3 คนและผู้ร่วมงานอีก 2 คน จากสำนักข่าว Democratic Voice of Burma ซึ่งเป็นสำนักข่าวชื่อดังที่มีจุดยืนต่อต้านกองทัพเมียนมาร์

ถึงแม้ว่าผู้สื่อข่าวและผู้ร่วมงานรวม 5 คนจะได้รับการรอลงอาญา แต่ก็มีความเสี่ยงที่พวกเขาจะถูกส่งตัวกลับไปเผชิญภยันตรายที่เมียนมาร์

ผมขอเรียกร้องให้ทางการไทยที่เกี่ยวข้องเคารพต่อพันธะกรณีของประเทศไทยต่อหลักการ Non-refoulement ซึ่งอยู่ในอนุสัญญาต่อต้านการทรมาณแห่งสหประชาชาติ (UNCAT) และอนุสัญญาระหว่างประเทศว่าด้วยการคุ้มครองบุคคลทุกคนจากการบังคับให้หายสาบสูญ (ICPPED) ที่ประเทศไทยเป็นภาคีและร่วมลงนามตามลำดับ รวมไปถึงคำมั่นสัญญาที่รัฐบาลไทยได้ให้ไว้กับประชาคมระหว่างประเทศว่า ทางการไทยกำลังประสานงานเพื่อหาแนวทางช่วยเหลือทางมนุษยธรรมในกรณีของผู้สื่อข่าวและผู้ร่วมงาน 5 คนนี้

ในการนี้ ผมขอย้ำว่าระบอบประยุทธ์ต้องปฏิบัติตามคำมั่นสัญญาที่ให้ไว้อย่างเคร่งครัด และต้องไม่บังคับส่งผู้ลี้ภัยคืนกลับประเทศที่พวกเขาเพิ่งลี้ภัยจากการประหัตประหาร รวมถึงการทรมานและความตายจากน้ำมือกองทัพเมียนมาร์ ที่มีท่าทีเพิกเฉยต่อหลักสิทธิมนุษยชนและศักดิ์ศรีความเป็นมนุษย์อย่างชัดเจนมากขึ้นครั้งแล้วครั้งเล่า นอกจากนี้ เจ้าหน้าที่ตำรวจตรวจคนเข้าเมืองต้องเคารพความประสงค์ของทั้ง 5 คน ในการขอลี้ภัยต่อไปประเทศที่สาม แทนที่จะถูกนำตัวส่งกลับเมียนมาร์

ตลอดเวลาที่ผ่านมา รัฐบาลเผด็จการทหารของเมียนมาร์ มีท่าทีอย่างชัดเจนต่อการทรมานและการสังหารนักโทษทางการเมืองอย่างไม่ลังเล จึงไม่มีเหตุผลใดที่จะคาดหวังให้เกิดท่าทีที่แตกต่างออกไปในกรณีนี้

รัฐบาลไทยต้องเคารพต้องคำมั่นสัญญาที่ให้ไว้ เพื่อรับประกันความปลอดภัยของเหล่าผู้ที่ลี้ภัยจากการกดขี่ทางการเมืองและความรุนแรงในเมียนมาร์ และเหนือสิ่งอื่นใดทางการไทยต้องไม่สมรู้ร่วมคิดกับการกระทำอาชญกรรมของกองทัพพม่าต่อประชาชนเมียนมาร์

[Statement on the Court’s Decision to Sentence Myanmar Journalists to Prison]

I am deeply concerned by the Chiang Mai Provincial Court’s decision to sentence three Myanmar journalists working for the Democratic Voice of Burma, a well-known anti-Tatmadaw media outlet, and two of their associates to seven months in prison.
.
While the five journalists and associates are on parole, there is still a risk that they may be sent back to face persecution in Myanmar.
.
I urge the Thai authorities concerned to respect Thailand's international obligations, chief among which is the sacrosanct principle of non-refoulement enshrined in both the United Nations Convention Against Torture (UNCAT) and the International Convention for the Protection of All Persons from Enforced Disappearance (ICPPED), to which Thailand is a party and a signatory respectively. The Thai government has given reassurances to the international community that it has been seeking a humanitarian solution to the plight of the three journalists and their associates.

In this regard, I unequivocally call on the Prayut regime to make good on its promises and not forcibly extradite any persons fleeing from a well-founded fear of persecution, including torture and death at the hands of the Tatmadaw whose callous disregard for human rights and human dignity has been made clear time and time again. Most importantly, I urge the Immigration Police to respect the journalists’ wishes by resettling them to a third country, instead of deporting them to Myanmar.

The military junta in Myanmar has made it abundantly clear that it had no qualms about torturing and murdering political prisoners, and there is no reason to expect any difference in this case.

The Thai government must honor the commitment it made to guarantee the safety of those fleeing political persecution and violence in Myanmar. Most importantly, Thailand must not be complicit to the Tatmadaw’s crimes against the people of Myanmar.
