จดหมายเปิดผนึก ถึงท่านเอกอัครราชทูตประจำประเทศเยอรมันนี ฉบับที่1

กลางดึกคืนหนึ่งปลายปี ลมหนาวพัดเอื่อยๆผ่านลูกกรงเข้ามาทางห้องขังแดน 4 เพื่อนผู้ต้องขังหลายคนหลับไปแล้ว จะมีก็แต่เพนกวินที่นอนอ่านหนังสือเรียนของเขาอยู่ ส่วนหนังสือเตรียมสอบทนายของไผ่ ถูกเอามาพันผ้าห่มใช้แทนหมอนหลังจากเมื่อช่วงสัปดาห์ที่แล้ว ศาลไม่ให้เขาประกันตัวออกไปสอบตั๋วทนาย ซึ่งได้สอบกันไปเมื่อวันที่ 26 ธ.ค. ที่ผ่านมา

ชีวิตในเรือนจำของพวกเรานักโทษทางการเมือง ยังคงดำเนินต่อไป หลังจากมันดำเนินมาสักระยะหนึ่งตั้งแต่การลุกขึ้นสู้เพื่อสิทธิเสรีภาพและความเท่าเทียมเมื่อกลางปีที่แล้ว คุกจึงกลายเป็นเครื่องมือในการปิดปาก ไม่ให้เรียกร้องหรือใฝ่ฝันถึงสังคมที่ดีงามอย่างที่ควรจะเป็น

อย่างไรก็ตาม กระผมต้องขอขอบคุณทางสถานทูตเยอรมันที่ยังเฝ้าติดตามการละเมิดสิทธิมนุษยชนในไทยตลอดมา สัปดาห์ที่แล้วที่ผมขึ้นศาล ผมได้พบกับเจ้าหน้าที่ทูตของท่านและได้รับกำลังใจ รวมถึงความห่วงใยอย่างดียิ่ง นอกจากนี้ยังทราบว่าหลายประเทศในยุโรปยังคงติดตามสถานการณ์ การละเมิดสิทธิมนุษยชนในไทยอย่างใกล้ชิด
.
ในประเทศที่ไม่มีสิทธิเสรีภาพ การจองจำนักศึกษา ประชาชนที่ออกมาเรียกร้องประชาธิปไตยก็จะมีให้เห็นอยู่เช่นนี้ ความขัดแย้งทางการเมืองของไทย แทบไม่เคยมีการเปิดพื้นที่ให้การพูดคุย ผู้มีอำนาจจากอดีตถึงปัจจุบัน ก็ยังคงใช้ความรุนแรง ทั้งที่เป็นอาวุธและในนามของกฎหมาย ทำร้ายและทำลายพวกเราอย่างไร้มนุษยธรรม

กระผมทราบว่าในประเทศของท่านได้ผ่านช่วงเวลาในประวัติศาสตร์อันเป็นบทเรียน ทำให้ประเทศของท่านเข้มแข็ง เรียนรู้ ต่อสู้กับผู้ปกครองที่ละเมิดศักดิ์ศรีความเป็นมนุษย์ จนเปลี่ยนผ่านมาสู่การเป็นประเทศที่เป็นเสาหลักด้านสิทธิมนุษยชนอย่างสง่างาม ทั้งยังให้ความสำคัญต่อเรื่องสิทธิมนุษยชนเป็นอย่างมาก ถึงขนาดที่บัญญัติไว้ในมาตราแรกของรัฐธรรมนูญแห่งเยอรมันนี ซึ่งแตกต่างกับประเทศของกระผมที่แม้มีรัฐธรรมนูญ ให้สิทธิ เสรีภาพแต่ก็หาใช้ได้จริงไม่ เสรีภาพในการชุมนุม เสรีภาพในการแสดงออกทางการเมืองถูกทำลายลงด้วยอาวุธปืน น้ำผสมสารพิษและกระบวนการทางศาล

กล่าวโดยเฉพาะ ภายหลังการลุกขึ้นเรียกร้องประชาธิปไตยของพวกเรา รัฐได้ใช้ความรุนแรงในการสลาขการชุมนุม จับกุมคนที่แสดงความเห็นโดยสุจริตจำนวนมาก ยัดข้อหาที่ไม่เป็นธรรม จนกระทั่งในขณะที่เขียนจดหมายถึงท่านอยู่นี้ กระผมกับเพื่อนๆก็ยังถูกขัง เพียงเพราะออกมาเรียกร้องให้มีการปฎิรูปสถาบันกษัตริย์ให้สอดคล้องกับสังคมประชาธิปไตย บางคนถูกฟ้องเพียงเพราะใส่เสื้อคร็อปท็อป แม้กระทั่งนักศึกษาที่เดินทางไปยื่นหนังสือที่สถานทูตของท่านก็ยังถูกฟ้องและถูกคุมขังอยู่ที่เรือนจำหญิงแห่งหนึ่ง

ชะตากรรมของพวกเรา มิได้เกินความคาดหมาย เมื่อคำนึงถึงความโหดร้ายของชนชั้นปกครองในอดีต เพียงแต่อาจจะเกิดความน้อยเนื้อต่ำใจอยู่บ้างก็ตรงที่พวกเขาเหล่านั้นไม่เห็นถึงความจริงใจที่พวกเราออกมาพูดอย่างตรงไปตรงมาเพื่อแสวงหาทางออกร่วมกัน ยิ่งไปกว่านั้น การพูดอย่างตรงไปตรงมาของพวกเรา ยังถูกมองเป็นความรุนแรง ขณะที่การใช้อาวุธเข้าสลายการชุมนุมโดยรัฐถูกมองเป็นเรื่องปกติ

ขณะเดียวกัน ศาลที่เคยให้ความยุติธรรมในอรรถคดีทุกเรื่อง พอมาถึงการบังคับใช้มาตรา 112 กลับเป็นข้อยกเว้นแห่งความยุติธรรม เป็นเสมือนหลุมดำที่บรรดาตุลาการมิอาจมีเรี่ยวแรงฝ่าข้ามไปได้

ลมหนาวอีกระลอกของคืนนี้พัดมาแล้ว เสียงกรนของเพื่อนๆยังคงขับกล่อมห้องขังอยู่ กระผมต้องจบจดหมายฉบับแรกเพียงเท่านี้และหากไม่เป็นการรบกวนท่านจนเกินไป กระผมหวังว่าท่านจะได้โปรดตอบจดหมายหรือเขียนมาบอกเล่าเรื่องราวของโลกภายนอกให้กระผมและเพื่อนๆฟังในเรือนจำ

ในโอกาสปีใหม่ที่ใกล้จะถึง กระผมขอส่งความสุข ความปรารถนาดีมายังท่านและฝากไปถึงพี่น้องชาวเยอรมันทุกคน หวังว่าท่านจะได้รับจดหมาย ตลอดจนพรปีใหม่นี้

Open Letter No. 1 to the German Ambassador to Thailand
Late one evening, close to the end of the year, a cold breeze flows through the bars into a cell in Zone 4. Many of my fellow prisoners are already asleep. Only Penguin [Parit Chiwarak] lays awake reading his textbooks. Pai’s [Jatupat Boonpattararaksa] prep book for the bar exam has been wrapped in a blanket to use as a pillow since last week when the Court denied his request for bail. He requested bail to take the exam, which was set for 26 December.
Our lives continue on as political prisoners behind bars. Since the uprising to struggle for rights, freedom and equality in the middle of last year, the prison has become an instrument to silent us and prevent us from dreaming of and calling for the beautiful society that should exist.
Anyway, I wish to thank the Embassy of Germany for monitoring the violation of human rights in Thailand. This past week, I met with your diplomatic staff when I went to court. They provided encouragement and expressed great concern. In addition, I learned that many countries in Europe are closely following the situation of the violation of human rights in Thailand.
As you can see, in this country without rights and freedoms, students and people who demand democracy are locked up. The political conflict in Thailand barely allows any space for discussion. From the past until the present, those who hold power use violence – both weapons and the law – to inhumanely attack and destroy us.
I am aware that your country passed a period in history that imparted lessons that have made you strong and cognizant of the importance of struggling against rulers who trample on human dignity. Your country transitioned into a dignified pillar of human rights. Human rights are given such significance that they are prescribed in the first article of the German Constitution. This is different from my country. Even though we have a constitution that provides for rights and freedoms, they cannot be found in reality. Freedom of assembly and freedom of political expression have been destroyed by guns, water mixed with toxic chemicals, and legal proceedings.
In particular, after our uprising to demand democracy, the state used violence to disperse demonstrations, arrested a large number of people who sincerely expressed their opinions, and slammed us with unjust charges. As I write you this letter, my friends and I remain locked up simply because we demanded reform of the institution of the monarchy to be in line with a democratic society. Some people have been charged merely for wearing crop-tops. Even one of the university students who went to submit a letter to your embassy has been charged and remains currently detained in the women’s prison.
Our fate is not beyond what we anticipated upon taking the cruelty of the ruling class in the past into consideration. Yet it may cause some resentment that they fail to recognize our sincerity in speaking directly in order to find a collective solution. Moreover, our frank speech is viewed as violence, while the state’s use of weapons to disperse demonstrations is viewed as nothing out of the ordinary.
Simultaneously, the courts previously provided justice in every kind of case. But when it comes to the enforcement of Article 112, an exception to justice takes place. It is as if there is an abyss that all of the judges lack the strength to overcome.
The cold breeze wafts through once again tonight. The snores of my friends serenade the cell. I must conclude my first letter to you here. If it is not too much of a bother, I hope you will please answer my letter and tell me and my fellow prisoners what is going on in the outside world.
On the occasion of the soon-to-be New Year, I send happiness and good wishes to you and all of the German brothers and sisters. I hope you will receive this letter and my New Year’s wishes.
