To Mark Zuckerberg from Thai Facebook users who cherish democracy.

Dear Mark Zuckerberg,
We wish to thank YOU for creating Facebook: a space that has greatly enabled Thai people to share memories, feelings and thoughts with their beloved relatives and friends in their own motherland - and with people all over the world.
Facebook has grown rapidly in Thailand in recent years. In part this rapid growth is a result of the political climate in Thailand, where a royalist, military junta is imposing heavy censorship on all forms of media and communication and actively encouraging the exercise of Thailand's archaic and draconian laws of Lèse-majesté.
Accurate, honest reporting of events in Thailand is not possible within Thailand. This makes it close to impossible for Thai people in Thailand to form accurate analysis of their own situation and circumstances in Thailand.
For the great number of Thai people who cherish the principles of democracy, the maintenance of open, on-line cyberspace is now a matter of critical importance, and Facebook is now a most important meeting place and medium for Thailand's 30 million FB users - for almost half the population - to follow political developments, to glean information from an as wide a spectrum of opinion as possible and form more-or-less up-to-date views and opinions that can then be communicated and debated openly.
The military coup d'états staged of 2006 and 2014 have not led to social or economic stability or peace and millions of Thai people are becoming extremely tired in their struggle to remain rational in defence of democracy, and keep hold of potentials that can prevent the re-establishment of a hierarchical, authoritarian social order.
On one side of this political conflict stands the great majority of the population demanding that the outcome of elections be respected. On the other the minority - the royalist power-elite hand-in-hand with the new urban elite, is clinging to beliefs in their having a divine right to rule.
We would like to mention briefly that decades of political turmoil in Thailand deepened significantly after the military crack-down in 2010 and simultaneous exercise of the Emergency Decree Act (2005), the Computer Crimes Act (2007), wide implementation of martial law, especially after the 2014 military coup, and increasing application of the law of Lèse-majesté. The six or seven Governments we have had since the 2006 military coup have all focused on blocking the freedom of public media and the freedom of individual people to express themselves, especially on issues relating to the power of the institutions under patronage of the monarchy.
All this is contributing to making Facebook the most significant platform for both within and without Thailand for political discussion, and a channel through which Thai people can vent their legitimate frustrations. In the Thai political arena, the 'red shirt' mobilization has had a highly significant enfranchising impact on the political awareness of millions of Thai citizens, notably the rural majority. In response to this the royalist camp and new urban elite have mobilized to re-establish their advantages in all areas of administration, particularly with regard to control of the judiciary.
The most effective non-military tool in the royalist political arsenal is Article 112 of the Thai Criminal Code: the instrument for silencing 'people who think differently'. This law of lèse-majesté states that: “Whoever defames, insults or threatens the King, Queen, the Heir-apparent or the Regent, shall be punished with imprisonment of three to fifteen years." The law allows itself to be used by anybody to accuse anybody.
The exact numbers are unknown. However, it estimates that since 2006 more than 1,000 people have been charged under Article 112 and dozens of these people have been detained in prison indefinitely. Many of those charged are, indeed, experienced activists and campaigners for democracy. Many of them are also just regular citizens who want some straight talking, men and women young and old, writers of conscience, academics, journalists, students, farmers and workers, also people from mainstream business. Several have been forced to flee this old Land of Smiles and have sought political asylum elsewhere – for more than 200 people.
In all three of our most recent General Elections (2006, 2007, 2011) the royalist elites have lost by huge margins.
It seems, now, that even Thai Facebook pages are beginning to be dominated by fascist elements who work in packs to intimidate whoever they feel like intimidating (please see the attachment). There is now a Facebook network called “Rubbish Collection Organization” whose objective it is to mount witch-hunts against any individual deemed to not be demonstrating sufficient loyalty towards the monarchy. Posts and comments aim at encouraging royalist sympathisers to assault, physically as well as mentally to anyone who thinks differently about the monarchy. FB users deemed guilty of not demonstrating sufficient love towards the King could find themselves being charged under Article 112.
Since the military coup d’état in May 2014, royalist networks, official, unofficial and undercover, have been increasingly turning to FB postings and articles for evidence to get people charged with Lèse-majesté under Article 112.
This royalist tactic of forming groups to spy on Facebook users is alarming. Under Article 112, normal, rational people are forced to live in a shadow of fear, in fear of being declared guilty of thinking differently, in fear of many forms of social sanctioning and threats of mental, material and physical reprisal. This means that many Facebook users cannot risk revealing or confirming their identity and, similarly, cannot stand-up to defend their position when their Facebook account is closed-down.
On the other hand, as if protected, the Facebook accounts of royalists appear free from all threats of being closed-down even when they also coexist under pseudonyms. No matter how aggressive, protecting themselves with some 'Love the King' suffix, royalist cyber-scouts seem to be able to focus on intimidating regular FB users without having to worry about being closed-down.
We write in hope that YOU and your Facebook team will give these concerns and this appeal your serious attention.
There are complaints from the Thai people on every day of these days that their Facebook pages have been closed-down - as a result of royalist reporting to Facebook.
It appears that these days, the voices critical to the royalist military regime in Thailand are being bullied , even through Facebook into either de-activating themselves through fear of reprisals, or to having their Facebook closed-down by Facebook.
We feel that we must communicate with YOU, in person, in order to inform YOU of the conditions in Thailand and of the difficulties that many Thai Facebook users who have been struggling for freedom and democracy are currently experiencing.
We would like to confirm that, under the political set-up that presently rules Thailand, at a time when freedom of expression in Thailand is once again being heavily supressed, Facebook is functioning as a vital communication channel for tens of millions of Thai.
When, even in the universities, freedom to process let alone analyse and draw conclusions is prohibited, the significance of Facebook as an educational space where people can study and share info about what seems to be going on in their own country, is truly significant, especially for those engaging in struggle for fully representative democracy.
We feel that the current Thai experiences present Facebook, yet again, with an opportunity to recognize how important and necessary FB has become vital in our common struggle for a free world.
We would like to request Facebook, the following:
- to recognize that closing-down the FB pages of people being reported by Thai royalists / royalist networks does not serve the interests of our common struggle to uphold the principles of democratic governance or the interests of the free world.
In light of this we propose that Facebook should establish certain standards of investigation before deciding to terminate people from using their Facebook pages, for instance, in the case of Thailand, by establishing protocol to communicate with e.g. a person being reported or being accused to FB by the Thai royalists (in order to weaken royalist opposition), and to provide the accused with decent opportunity to not only defend but also to protect themselves.
- to investigate, on an equal basis, hate-speech from the royalist camp, especially threats of mental or physical injury or even invitation to commit murdering or assassinating or hurting people who are thinking differently from the Thai royalists.
- to adhere to the principle of protecting the privacy of Facebook users and to not disclose Thai Facebook user information to other organizations, especially to organizations working for or affiliated to the military junta ruling in Thailand.
We wish and hope that YOU will hear our voices and concerns.

พวกเราขอแสดงความขอบคุณ ที่คุณได้สร้างสรรค์ Facebook ซึ่งเป็นพื้นที่สำคัญยิ่งที่ช่วยให้คนไทยได้สามารถ แลกเปลี่ยนความทรงจำ ความรู้สึก และความคิด กับเพื่อนและญาติพี่น้องที่รักในประเทศบ้านเกิด – และกับผู้คนจากทั่วทุกมุมโลก
เฟซบุ๊คได้ขยายตัวและเติบโตอย่างมากในประเทศไทยในชั่วระยะเวลาไม่กี่ปีที่ผ่านมา ซึ่งการเติบโตของเฟซบุ๊คอย่างรวดเร็วเช่นนี้ ก็มีส่วนมาจากบรรยากาศทางการเมืองในประเทศไทยด้วยเช่นกัน เมื่อรอยัลลิสต์ (คนรักเจ้า) และเผด็จการทหาร ได้ทำการเซ็นเซอร์การสื่อสารทุกชนิดอย่างรุนแรง รวมทั้งยังกระตุ้นให้มีการใช้กฎหมายหมิ่นพระบรมเดชานุภาพอันล้าหลังและป่าเถื่อนทำร้ายผู้คนกันอย่างจริงจังอีกด้วย
การรายงานถึงเหตุการณ์ที่เกิดขึ้นประะเทศไทยอย่างซื่อสัตย์และตรงไปตรงมาทำไม่ได้ในประเทศไทย และมันก็แทบจะเป็นไปไม่ได้เลยที่คนในประเทศไทย จะสามารถวิเคราห์สถานการณ์และเรื่องราวที่เกิดขึ้นกับพวกเขาได้อย่างถูกต้องครบถ้วน
การมีพื้นที่เปิดในโลกออนไลน์จึงเป็นเรื่องที่มีความจำเป็นอย่างยิ่งต่อคนไทยจำนวนมากที่เชิดชูหลักการแห่งประชาธิปไตย และเฟซบุ๊คก็ได้กลายเป็นพื้นที่แห่งการพบปะสื่อสารระหว่างกันของผู้ใช้เฟซบุ๊คชาวไทย 30 ล้านคน – หรือเกือบถึงครึ่งหนึ่งของประชาชนทั้งประเทศ – เพื่อการติดตามพัฒนาการทางการเมือง เพื่อค้นคว้ารวบรวมข้อมูลและความคิดเห็นในวงกว้างให้มากที่สุดที่จะมากได้ เพื่อที่อย่างน้อยพวกเขาก็จะได้มีทัศนคติหรือมุมมองที่รอบด้านมากขึ้น เพื่อที่จะได้ใช้สื่อสารและถกเถียงกับผู้คนได้อย่างแม่นยำขึ้น
รัฐประหารที่เกิดขึ้นในไทยในปี 2549 และ 2557 ไม่ได้นำมาซึ่งเสถียรภาพทั้งทางด้านสังคม เศรษฐกิจ หรือสันติภาพ และผู้คนหลายสิบล้านคนในประเทศไทยต่างก็เหน็ดเหนื่อยกันอย่างเหลือเกิน กับการที่ต้องต่อสู้เพื่อยืนยันถึงเหตุผลของความจำเป็นที่จะต้องปกป้องประชาธิปไตย และในขณะเดียวกันก็ต้องพยายามเกาะเกี่ยวไว้ซึ่งหนทางที่จะทำได้ เพื่อป้องกันไม่ให้วิถีเผด็จการฟื้นคืนอำนาจและทำหน้าที่ควบคุมสังคมจากเบื้องบนได้อีกครั้ง
ในด้านหนึ่งของสถานการณ์ความขัดแข้งทางการเมือง คือ ประชากรกลุ่มใหญ่ที่เรียกร้องให้ประชาชนทั้งประเทศเคารพกติกาการ "เลือกตั้ง" กับอีกด้านหนึ่ง คือ ประชาชนกลุ่มน้อยรอยัลลิสต์ชนชั้นสูงที่กุมอำนาจการเมืองที่ร่วมมือกับชนชั้นกลางใหม่ในเมือง เกาะกุมยึดเหนี่ยวในความเชื่อว่าสิทธิในการปกครองประเทศขึ้นอยู่กับชาติกำเนิด
พวกเราขอกล่าวโดยสังเขปว่า ในช่วงหลายทศวรรษแห่งความวุ่นวายทางการเมืองในประเทศไทย ที่ถูกทำให้รุนแรงยิ่งขึ้นอย่างต่อเนื่อง หลังจากการที่ทหารใช้กำลังปราบปรามประชาชนในปี 2553 และการประกาศใช้พรก. ฉุกเฉิน (2548) พรบ. คอมพิวเตอร์ (2550) ร่วมไปกับประกาศกฎอัยการศึกในพื้นที่ครอบคลุมอย่างกว้างขวางหลังรัฐประหาร 2557 ผนวกกับการใช้กฎหมายหมิ่นพระบรมเดชานุภาพอย่างรุนแรงมากขึ้น ทั้งนี้รัฐบาล 6 หรือ 7 คณะ นับตั้งแต่รัฐประหาร 2549 ต่างก็ปิดกั้นเสรีภาพของสื่อมวลชนและเสรีภาพของประชาชนในการแสดงออก โดยเฉพาะในประเด็นที่เกี่ยวกับเรื่องขอบเขตอำนาจของสถาบันต่างๆ ภายใต้ราชอุปภัมภ์
สาเหตุเหล่านี้ ทำให้เฟซบุ๊คได้กลายเป็นพื้นที่สำคัญในการพูดคุยเรื่องการเมือง ทั้งจากในประเทศไทยและนอกประเทศ และเป็นช่องทางที่ชอบธรรมที่ทำให้คนไทยสามารถแสดงออกถึงความอึดอัดคับข้องใจ ภายในสถานการณ์การเมืองไทยเช่นนี้ การรวมตัวของ "คนเสื้อแดง" เพื่อสิทธิในการเลือกตั้ง ได้ส่งผลต่อการตื่นตัวทางการเมืองของประชาชนหลายสิบล้านคน โดยเฉพาะประชาชนในชนบท และขบวนการรอยัลลิตส์และชนชั้นกลางอภิสิทธิชนใหม่ในเมืองหลวง ก็พากันตอบโต้การตื่นตัวของประชาชนเสื้อแดงด้วยการใช้ความได้เปรียบกว่า จากการที่สามารถกุมอำนาจโครงสร้างการบริหารประเทศไว้ได้ โดยเฉพาะการมีอำนาจเหนือกระบวนการยุติธรรม
เครื่องมือที่ทรงประสิทธิภาพมากของชาวรอยัลลิสต์ในการกุมสภาพทางการเมืองนอกเหนือจากทหารแล้ว ก็คือ ประมวลกฎหมายอาญา มาตรา 112 ที่ถูกใช้เป็นเครื่องมือปิดปากคนคิดต่าง กฎหมายหมิ่นพระบรมเดชานุภาพ ฉบับนี้ระบุว่า “ผู้ใดหมิ่นประมาท ดูหมิ่น หรือแสดงความอาฆาตมาดร้ายพระมหากษัตริย์ พระราชินี รัชทายาท หรือผู้สำเร็จราชการแทนพระองค์ ต้องระวางโทษจำคุกตั้งแต่ 3 ปีถึง 15 ปี” กฎหมายนี้อนุญาตให้ใครก็ได้ จะใช้ฟ้องร้องกล่าวโทษใครอย่างไรก็ได้
ตัวเลขของผู้ถูกฟ้องร้องจับกุมด้วยมาตรา 112 นั้นไม่มีใครทราบแน่ชัด แต่จะกล่าวได้แน่ๆ ว่า นับตั้งแต่ปี 2549 มีประชาชนมากกว่าพันคน ที่ถูกฟ้องร้องหรือดำเนินคดีด้วยมาตรา 112 และหลายสิบคนยังถูกคุมขังอยู่ในคุกจนบัดนี้ หลายคนคือคนที่รณรงค์เพื่อประชาธิปไตยในประเทศไทยมาอย่างยาวนาน แต่หลายคนก็เป็นชาวบ้านทั่วไปที่ต้องการที่จะพูดอะไรอย่างตรงไปตรงมา พวกเขามีทั้งหญิงและชาย ทั้งเยาวชนและคนแก่ ทั้งเป็นคนทำงานสื่อ นักเขียน นักศึกษา คนขายซีดี ชาวนา ชาวไร่ รวมทั้งคนในภาคธุรกิจ และมีคนจำนวนมากที่ต้องถูกบีบให้ละทิ้งดินแดนแห่งรอยยิ้ม และลี้ภัยการเมืองไปยังประเทศต่างๆ ทั่วโลก ซึ่งขณะนี้มีจำนวนมากกว่า 200 คน
ในการเลือกตั้ง 3 ครั้งล่าสุดที่ผ่านมา (2549 2550 และ 2554) ค่ายรอยัลลิสต์ชนชั้นสูงแพ้การเลือกตั้งอย่างเห็นได้ชัดเจนมาโดยตลอด
มันจึงดูเหมือนว่า แม้แต่พื้นที่ของเฟซบุ๊ค ก็ถูกครอบครองจากฝ่ายฟาสซิสต์รอยัลลิสต์ ที่ทำงานกันเป็นกลุ่มก้อน เพื่อข่มขู่ คุกคาม คนเสื้อแดงหรือคนที่พวกเขาต้องการคุกคาม (ดูตัวอย่างตามเอกสารแนบ) ในขณะนี้มีเพจในเฟซบุ๊คชื่อว่า "องค์กรเก็บขยะแผ่นดิน" ที่มีเป้าหมายเพื่อการล่าคนที่พวกเขาเห็นว่าไม่ได้แสดงความจงรักภักดีต่อสถาบันกษัตริย์อย่างเพียงพอ พวกเขาได้โพสต์และแสดงความคิดเห็นต่างๆ ที่กระตุ้นให้แนวร่วมของพวกเขา ได้ไปกระทำการระราน ข่มขู่และทำร้าย – ทั้งทางด้านจิตใจและด้านร่างกาย – ต่อใครก็ตามที่คิดเห็นเกี่ยวกับสถาบันกษัตริย์แตกต่างจากพวกเขา ผู้ใช้เฟซบุ๊คจะถูกถูกทำให้เป็นผู้ผิด ถ้าพวกเขาไม่ได้แสดงความรักต่อในหลวงอย่างมากพอ และจะสามารถถูกฟ้องร้องดำเนินคดีด้วยกฎหมายมาตรา 112 ได้อีกด้วย
นับตั้งแต่รัฐประหาร 22 พฤษภาคม 2557 เครือข่ายรอยัลลิสต์ทั้งที่จัดตั้งโดยทางการ โดยไม่เป็นทางการ และโดยพวกนอกเครื่องแบบ ได้ใช้ข้อความหรือบทความที่โพสต์กันในเฟซบุ๊ค เป็นพยานหลักฐานในการฟ้องร้องเอาผิดผู้คนตามมาตรา 112 เพิ่มสูงขึ้น
การที่เครือข่ายรอยัลลิสต์ใช้เทคนิคการรวมกลุ่มเพื่อไปตามสอดส่องผู้ใช้เฟซบุ๊คคนอื่นๆ เป็นประเด็นที่น่าเป็นห่วง ภายใต้มาตรา 112 ประชาชนคนทั่วไปถูกบีบให้ต้องอยู่ภายใต้เงาแห่งความกลัว ทั้งความกลัวที่จะต้องถูกโจมตีว่ากระทำความผิด เพราะมีความคิดเห็นที่แตกต่างจากชาวรอยัลลิสต์ กลัวทั้งการจะถูกมาตรการกดดันต่างๆ จากสังคม และกลัวการถูกข่มขู่คุกคาม ที่ส่งผลต่อการเสียสุขภาพจิตหรืออาจจะได้รับอันตรายจากการถูกทำร้าย นั่นก็หมายความว่า ผู้ใช้เฟซบุ๊คจำนวนไม่น้อย ไม่อาจเสี่ยงที่จะเปิดเผยตัวตนหรือยืนยันตัวตนที่แท้จริงของพวกเขาได้ และด้วยเหตุผลเดียวกัน ไม่อาจแก้ต่างแทนตัวเองได้เมื่อเพจของพวกเขาในเฟซบุ๊คถูกปิด
พวกเราเขียนจดหมายฉบับนี้ ด้วยความหวังว่าคุณมาร์ค และทีมงานเฟซบุ๊ค จะใส่ใจอย่างจริงจังต่อความวิตกกังวลและห่วงใยขอพวกเรา รวมทั้งข้อเสนอของพวกเราในครั้งนี้
ในแทบทุกวัน พวกเราจะได้ยินคนไทยแจ้งข่าวสารว่าเพจในเฟซบุ๊คถูกปิด – อันเนื่องมาจากการระดมรีพอร์ตของขบวนการรอยัลลิสต์
ในทุกวันนี้ มันดูเหมือนว่า คนที่กล้าส่งเสียงวิพากษ์วิจารณ์เผด็จการทหารรอยัลลิสต์ในประเทศไทย ต่างก็ถูกข่มเหงรังแก รวมทั้งในเฟซบุ๊คด้วย ทำให้พวกเขา ถ้าไม่ปิดตัวเองเพราะกลัวจะถูกคุกคามหรือถูกดำเนินคดี ก็อาจถูกร้องเรียนจนถูกเฟซบุ๊คปิดเพจ
พวกเราจึงคิดว่า มันจำเป็นที่จะต้องสื่อสารถึงคุณมาร์คโดยตรง เพื่อบอกเล่าเรื่องราวความยากลำบากต่างๆ นานา ที่ผู้ใช้เฟซบุ๊คชาวไทย ที่กำลังพยายามต่อสู้เพื่อเสรีภาพและประชาธิปไตย ต้องประสบอยู่ในขณะนี้
พวกเราขอยืนยันว่า ภายใต้สภาพการเมืองของประเทศไทยในปัจจบัน ซึ่งเป็นอีกครั้งหนึ่งที่เสรีภาพในการแสดงออกถูกปิดกั้นอย่างรุนแรง เฟซบุ๊คได้กลายเป็นช่องทางการสื่อสารที่สำคัญของประชาชนชาวไทยหลายสิบล้านคน
โดยเฉพาะเมื่อ แม้กระทั่งในมหาวิทยาลัยต่างๆ เสรีภาพเพียงแค่ในการจะศึกษาข้อมูล ไม่ต้องถึงขึ้นการวิเคราะห์ด้วยซ้ำไป เป็นเรื่องที่กระทำไม่ได้ เฟชบุ๊คจึงได้กลายเป็นพื้นที่แห่งการสื่อสารและศึกษาเรียนรู้เรื่องเกี่ยวกับการเมืองไทยที่สำคัญยิ่ง สำหรับประชาชนผู้ต่อสู้เพื่อประชาธิปไตยในประเทศไทย
พวกเราต่างก็รู้สึกว่า ประสบการณ์ของผู้ใช้เฟซบุ๊คในประเทศไทย ณ ขณะนี้ ต้องขอย้ำอีกครั้งหนึ่งว่า ได้กลายเป็นโอกาสที่จะทำให้ท่านได้ให้ตระหนักถึงความจำเป็นของเฟซบุ๊คต่อการต่อสู้เพื่อเสรีภาพของโลก
พวกเรามีเรื่องขอร้องต่อเฟซบุ๊ค ดังนี้
- โปรดตระหนักว่า การปิดเพจเฟซบุ๊ค ที่ถูกรุมรีพอร์ทจากรอยัลลิสต์ หรือขบวนการรอยัลลิสต์ของไทย ไม่ส่งผลดีต่อการต่อสู้ของประชาชน ที่ต่อสู้เพื่อยืนยันถึงอุดมการณ์แห่งการต้องมีรัฐบาลประชาธิปไตย หรือเพื่อเสรีภาพของโลก
ด้วยสาเหตุนี้ พวเราของเสนอว่า เฟซบุ๊ค ควรจะจัดทำมาตรการในการตรวจสอบก่อนที่จะตัดคนออกจากเฟซบุ๊ค ในกรณีของประเทศไทย โดยการวางระเบียบการที่จะสื่อสารกันก่อน อาทิ กับคนที่ถูกรีพอร์ทโดยรอยัลลิสต์ (เพื่อที่จะลดจำนวนคนที่อยู่ฝั่งตรงข้ามกับพวกรอยัลลิสต์) และเปิดให้ผู้ถูกรีพอร์ทได้มีโอกาส ไม่ใช่แค่แก้ต่างให้กับข้อความของพวกเขาเท่านั้น แต่ให้โอกาสพวกเขาได้สามารถคุ้มครองความปลอดภัยของตัวเองด้วย
- ขอให้ ดำเนินการตรวจสอบ ด้วยพื้นฐานเดียวกัน ถึงพฤติกรรม hate-sppech จากค่ายรอยัลลิสต์ โดยเฉพาะถ้อยคำข่มขู่เพื่อมุ่งทำร้ายจิตใจหรือร่างกาย หรือแม้กระทั่งเชิญชวนกันไปกระทำอาชญกรรมเพื่อตามล่าหรือสังหารผู้คนที่คิดต่างจากรอยัลลิสต์ไทย
- ขอให้ ยึดมั่น ในหลักการแ่หงการปกป้องความเป็นส่วนตัวของผู่้ใช้เฟซบุ๊ค และไม่แชร์หรือแบ่งปันข้อมูลผู้ใช้ให้กับหน่วยงานใด โดยเฉพาะหน่วยงานที่ทำงานกับหรือทำงานให้กับเผด็จการทหารของประเทศไทย
