เยอรมันเตรียมเก็บภาษีกษัตริย์คนใหม่ของไทย





อีกไม่กี่วันจะมีการสถาปนาพระมหากษัตริย์ไทยรัชกาลที่ ๑๐ หรือ เจ้าฟ้ามหาวชิราลงกรณ์ สยามมกุฏราชกุมารจะขึ้นทรงราชย์ เป็นพระบาทสมเด็จพระเจ้าอยู่หัว มหาวชิราลงกรณ์ฯ

แต่ขณะที่ทรงประทับอยู่ในเยอรมนี ณ เวลานี้ ปรากฏข่าวว่าอาจต้องทรงเสียภาษีให้แก่รัฐบาเยิร์น แคว้นบาวาเรีย เป็นจำนวนมหาศาล เนื่องจากที่นั่นมีการเก็บภาษีมรดกในอัตราสูง ๓๐ เปอร์เซ็นต์ และสมเด็จพระราชบิดาเพิ่งสวรรคต ทิ้งมรดกให้พระองค์ไม่น้อยกว่า ๔๐,๐๐๐ ล้านดอลลาร์

บาเยิร์นหวังเงินหลายพันล้านจากองค์รัชทายาท

ข้อพิเศษของกฏหมายเยอรมันอาจทำให้รัฐอิสระมีรายได้เข้ารัฐถึงสามพันล้านยูโร

การเสด็จสวรรคตของกษัตริย์ไทยอาจจะทำให้รัฐอิสระบาเยิร์นมีรายได้เข้ารัฐเป็นหลักพันล้านก็เป็นได้ เหตุผลเนื่องมาจากข้อกำหนดพิเศษของกฏหมายที่เรียกเก็บภาษีมรดก Manger Magazin ฉบับล่าสุดซึ่งออกวางจำหน่ายวันที่ 18 พฤศจิกายนได้รายงานเอาไว้

เมื่อเดือนตุลาคมที่ผ่านมากษัตริย์ภูมิพล อดุลยเดชได้เสด็จสวรรคตด้วยพระชนมายุ 88 ปีหลังจากทรงครองราชย์มายาวนานถึง 70 ปี มหาวชิราลงกรณ์ (64 ปี) ราชกุมารพระองค์เดียวของพระองค์ เป็นเจ้าของวิลล่า 2 หลังที่เมืองทุทซิงเง่นและเมืองเฟลดาฟิง ติดทะเลสาบชตาร์นแบร์ก “เนื่องจากองค์รัชทายาทมีที่พำนักในประเทศเยอรมนี ดังนั้นพระองค์จึงมีหน้าที่ต้องเสียภาษีมรดก” ดาเนียล เลฮ์มันน์ หุ้นส่วนหนึ่งของสำนักงานทนายความแห่งใหญ่ เบเคอร์ ทิลล่า เริล์ฟส์ แห่งเมืองมิวนิคได้ให้ข้อมูล

ราชสำนักไทยถือได้ว่าร่ำรวยอันดับต้น ๆ ในโลกนี้ ไม่ใช่เป็นเจ้าของแต่เฉพาะที่ดินในบ้านเกิดกว่า 6500 เฮ็คเตอร์ของตัวเองเท่านั้น แต่ยังเป็นผู้ถือหุ้นใหญ่ในบริษัทปูนซีเมนต์ไทยและธนาคารไทยพาณิชย์รวมทั้งผู้ถือหุ้นส่วนใหญ่ในโรงแรมเคมปินสกี้อีกด้วย คาดการณ์ว่าทรัพย์สินทั้งหมดมีมูลค่าประมาณ 40 พันล้านดอลล่าร์สหรัฐ

สมมติว่ามหาวชิราลงกรณ์มีทรัพย์สินแค่ 10 พันล้านยูโร รัฐมนตรีกระทรวงการคลังของรัฐบาเยิร์น นายมาร์คุส เซอร์เดอร์ (ซีดียู) อาจจะเรียกเก็บภาษีจากเงินจำนวนนั้นได้ร้อยละ 30 ซึ่งหมายความว่าจะเป็นเงินประมาณ 3 พันล้านยูโร ตลอดทั้งปี 2558 บาเยิร์นเก็บภาษีมรดกได้เพียง 1.3 พันล้านเท่านั้น

ต่อข้อซักถามถึงความลับด้านภาษี นายเซอร์เดอร์ รัฐมนตรีกระทรวงการคลังของรัฐบาเยิร์นตอบว่า “ยังให้ข้อมูลที่ชัดเจนในกรณีขององค์รัชทายาทแห่งประเทศไทยไม่ได้” แต่ว่าหากมีแหล่งพำนักในประเทศเยอรมนี ถือว่าผู้นั้นมีหน้าที่ต้องเสียภาษี “โดยไม่มีข้อยกเว้น”

A special feature of German law could bring the Free State up to three billion euros.

The death of the King of Thailand could bring a billionths to free-time Bavaria. The reason is a special feature of the German inheritance tax. This is reported by manager magazin in its latest issue, which will be released on 18 November.

In October, Thailand's monarch Bhumibol Adulyadej died after 70 years of regency at the age of 88 years. His only son Maha Vajiralongkorn (64) is the owner of two villas in Tutzing and Feldafing on Lake Starnberg. "Since the crown prince is domiciled in Germany, he is also subject to inheritance tax," says Daniel Lehmann, partner of the Grand Chancery Baker Tilly Roelfs in Munich.

Thailand's royal house is one of the richest monarchies in the world. He owns not only 6500 hectares of land at home. It is also a major shareholder of the Siam Cement Group and the Siam Commercial Bank and owns the majority in the Kempinski hotel chain. The total royalty is estimated at about US $ 40 billion.

Putting the assets inherited to Prince Vajiralongkorn with only ten billion euros, Bayern's Finance Minister Markus Söder (CSU) could get 30 percent of this: three billion euros. Throughout the year 2015, Bavaria took only 1.3 billion euros through the inheritance tax.

On request, Söders Ministry announced that it could not make any "concrete information" on the case of the Thai prince because of the tax secrecy. However, in the case of a place of residence in Germany, "unlimited tax liability" applies.
